1. Agreement to Terms

By accessing or using DSN Research's Predictive Analytics API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

DSN Research ("we", "us", or "our") provides data management, data analysis, business intelligence, machine learning, and artificial intelligence services through our API platform.

2. Description of Service

DSN Research provides a cloud-based API platform that offers:

• Data management and upload capabilities
• Advanced analytics and business intelligence tools
• Machine learning model training and predictions
• AI-powered insights and natural language processing
• Automated report generation

The Service is provided on a subscription basis with various pricing tiers, including a free tier with limited features.

3. Account Registration

3.1 Account Requirements

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate, complete, and current registration information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your API keys and account password. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Subscription Plans and Billing

4.1 Plan Types

We offer multiple subscription tiers:

• Free: Limited features with 100 API requests per day
• Basic: $15/month - Enhanced features and limits
• Pro: $49/month - Full analytics suite with AI features
• Premium: $99/month - Enterprise features with priority support
• Enterprise: Custom pricing - Unlimited access with dedicated support

4.2 Payment Terms

Paid subscriptions are billed in advance on a monthly basis. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice.

4.3 Payment Processors

Payments are processed through PayPal. By subscribing to a paid plan, you agree to the terms of service of the payment processor.

4.4 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account dashboard.

5. Acceptable Use Policy

5.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. Without limiting the generality of the foregoing, you agree not to:

• Use the Service in any way that violates applicable law or regulation;
• Transmit any malicious code, viruses, or harmful data;
• Attempt to gain unauthorized access to the Service, its infrastructure, or related systems;
• Interfere with or disrupt the Service, servers, or underlying networks;
• Transmit malicious code, viruses, or harmful data;
• Engage in any form of automated data collection (including scraping, crawling, or data mining) without our prior written permission;
• Resell, sublicense, or redistribute the Service or any portion thereof without explicit authorization;
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, models, business logic, or internal architecture of the Service;
• Systematically query, probe, or interact with the API manually or via automated means for the purpose of reconstructing, replicating, inferring, or training competing systems based on the Service's functionality, outputs, error patterns, or response structures;
• Use any output generated by the Service (including reports, predictions, scores, or metadata) to train, fine-tune, or develop machine learning models, AI systems, or predictive analytics tools that compete with or replicate DSN Research's offerings, except as expressly permitted under your subscription plan.

Violation of this section constitutes a material breach of these Terms and may result in immediate termination of your account, legal action, and injunctive relief without the need to post bond.

5.2 Rate Limits

Your use of the API is subject to rate limits based on your subscription tier. Excessive use beyond your plan's limits may result in temporary throttling or suspension of service.

6. Data and Privacy

6.1 Your Data

You retain all rights to the data you upload to the Service. By using the Service, you grant us a limited license to process, store, and analyze your data solely for the purpose of providing the Service.

6.2 Data Security

We implement industry-standard security measures to protect your data. However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security.

6.3 Data Retention

We retain your data for as long as your account is active or as needed to provide the Service. Upon account deletion, we will delete or anonymize your data within 90 days, except where retention is required by law.

7. Intellectual Property Rights

7.1 Service Ownership

The Service, including all software, algorithms, designs, and documentation, is and will remain the exclusive property of DSN Research and its licensors. These Terms do not grant you any rights to our trademarks or service marks.

7.2 API Access

We grant you a limited, non-exclusive, non-transferable license to access and use the API in accordance with these Terms and your subscription plan.

7.3 Feedback

If you provide us with feedback or suggestions about the Service, we may use such feedback without any obligation to you.

8. Service Level and Support

8.1 Service Availability

We strive to maintain 99.9% uptime for the Service, but we do not guarantee uninterrupted or error-free service. We may perform scheduled maintenance with advance notice.

8.2 Support

Support is provided based on your subscription tier:

• Free: Community support via documentation
• Basic & Pro: Email support (48-hour response time)
• Premium: Priority email support (24-hour response time)
• Enterprise: Dedicated support with SLA guarantees

9. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

We will notify you of any material changes to the Service at least 30 days in advance where possible.

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us at [email protected] or through your account dashboard. Upon termination, your right to use the Service will immediately cease.

10.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

10.3 Effect of Termination

Upon termination, all licenses and rights granted to you will immediately cease. We will delete your data in accordance with our data retention policy, unless retention is required by law.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DSN RESEARCH, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless DSN Research and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party right, including any intellectual property or privacy right
• Any data you submit to the Service

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of Cape Town, South Africa.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

16. General Provisions

16.1 Entire Agreement

These Terms constitute the entire agreement between you and DSN Research regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

16.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

16.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or Internet service provider failures.

17. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to a government embargo or designated as a "terrorist supporting" country.
